1. Acceptance of Terms
These Terms of Service (the “Terms”) form an agreement between you and FoxMeld (“we”, “us”, “our”) governing access to foxmeld.com and the image, video and music creation, product image processing, ecommerce insights, and related account services provided by FoxMeld (the “Service”). By creating an account, making a payment, or using the Service, you acknowledge that you have read and agree to these Terms, the Acceptable Use Policy, and the Refund Policy. Our Privacy Policy explains how we handle personal information. If you do not agree to these Terms, do not use the Service.
2. Accounts
The Service is intended for users aged 18 and over. You must provide true and accurate registration information, and you are responsible for safeguarding your account credentials and for all activity that occurs under your account. If you discover that your account has been compromised or used without authorization, please contact us immediately.
3. Credits and Subscriptions
Credits are virtual units used to measure and pay for creation tasks within the Service. They are not legal tender, cannot be redeemed for cash, and cannot be transferred to another account. Purchased credits are credited to the purchaser’s account credit pool. Allocating credits to a personal or team space does not change their owner or expiry date. Authorized team members use the Owner’s credits within their allowances; this is not a transfer of ownership.
Subscriptions are available with monthly or annual billing and renew automatically on the selected cycle until canceled. Subscription credits for each paid period are granted in a single allocation; annual billing grants 12 times the corresponding monthly credits at once. You may request cancellation of auto-renewal under subscription management in “Credits & subscriptions”. Check the cancellation status shown on the page: a pending request is not yet a confirmed cancellation. Once cancellation is confirmed, the subscription will not renew, and benefits for the current paid period remain active until that period ends.
Payments are processed through Waffo’s checkout page. FoxMeld does not store full card numbers or CVVs. The price, currency, and applicable taxes are as displayed at checkout; we will give advance notice of price changes affecting renewals. FoxMeld reviews refund requests and arranges approved refunds through the payment channel. If a generation ultimately fails without delivering a result, the system restores all credits reserved for that task. Restoring credits is not a cash refund. Credits have expiry dates by batch. The earliest-expiring batch is used first; batches with the same expiry date are used in the order received. Monthly subscription credits remain valid for an additional 30 days after their billing period during normal renewal. After you cancel auto-renewal, remaining credits from that subscription expire no later than the end of the current paid period. Annual subscription credits expire at the end of their annual period. Pay-as-you-go credits expire according to the purchased pack, and promotional credits follow the promotion’s rules. Space allocations do not extend expiry dates. Where the product permits a plan or billing-cycle change, the new option must be paid for in full. It takes effect upon payment confirmation, with credits granted for the new period; the original subscription remains unchanged if payment is not completed. Existing credits retain their expiry dates. The unused portion of the old period is not refunded, credited toward the new purchase, or added to the new period. Separate successful purchases of different plans or cycles are not automatically duplicate charges. Pay-as-you-go packs do not renew automatically. Their credits and temporary queue benefits have separate expiry dates and do not grant team-space creation or additional media storage.
4. Acceptable Use
You may use the Service only for lawful purposes and must not submit, generate, or use content prohibited by the Acceptable Use Policy, including pornographic, nude, or sexually suggestive content, non-consensual intimate imagery or face swaps, deceptive deepfakes, inappropriate content involving minors, extreme violence, terrorism, harassment, hate, or content that infringes others’ rights. You must not compromise, reverse engineer, or disrupt the Service.
When automated moderation is enabled, we screen text prompts for image and video generation before generation. We may block requests, remove violating content, or suspend or terminate associated accounts. Automated screening cannot guarantee detection of every violation. You must comply with the Acceptable Use Policy whether or not screening is enabled.
5. Your Content and Responsibility
You retain the rights you already hold in content you submit and must have the right to upload and use the materials concerned. You may use generated outputs to the extent permitted by applicable law and the relevant model service terms; this does not guarantee copyright protection, exclusivity, or suitability for commercial use. You grant us the permission necessary to provide the Service, maintain safety, and handle support requests, including processing, storing, displaying content to you, and sending necessary prompts, reference materials, and parameters to generation, moderation, or image processing providers.
AI-generated outputs may resemble results generated by others. We do not guarantee that generated content is non-infringing, nor do we warrant its fitness for any particular commercial purpose. You are solely responsible for the content you publish and use, and for its legality. The Service may invoke third-party models such as those provided by Google; FoxMeld is not affiliated with, endorsed by, or sponsored by any such vendor.
6. Our Intellectual Property
FoxMeld or the relevant rights holders own the intellectual property in the Service’s software, interface, branding, and orchestration logic. These Terms do not transfer those rights to you; they grant only a limited license to use the Service in accordance with these Terms.
7. Model Catalog, Regions, and Availability
FoxMeld aggregates and displays multiple third-party AI models. The appearance of a model name, API or API endpoint, price, capability description, or usage example on our website, application, or documentation means only that the model may be offered through the Service. It is not a promise that the model is available in every country, region, account, use case, or at all times, and does not imply authorization, sponsorship, endorsement, or warranty by the model provider.
Actual model availability may depend on the country or region from which your request originates, applicable law, sanctions or export controls, model-provider policies, account permissions, content rules, technical capacity, and service status. Models may be added, changed, suspended, or removed at any time. To enforce these restrictions, we may infer request origin from an IP address or network-edge information and reject an ineligible request at submission. A rejection based on a regional restriction occurs before a generation job is created or credits are deducted.
You are responsible for confirming that your use of the Service and selected model is lawful and compliant in your location and intended use. You must not use a VPN, proxy, falsified location, false account information, account sharing, or any other method to circumvent regional, access, or provider restrictions.
8. Changes and Termination
We may update, suspend, or adjust features of the Service. You may stop using the Service and request account deletion in “Account settings”; if you own a team space, you must transfer its ownership first. Account deletion and cancellation of auto-renewal are separate actions, so confirm that auto-renewal has been canceled before deleting your account. We may suspend or terminate your account if you violate these Terms. Data deletion is handled under the Privacy Policy. Download any materials and reports you wish to retain in advance.
9. Disclaimers
To the extent permitted by applicable law, the Service is provided “as is”. AI outputs and ecommerce insights may be inaccurate, incomplete, or similar to other users’ results. Ecommerce insights are based on the product information and reviews obtained; we do not guarantee coverage of all reviews or any commercial outcome. Standard white-background product images are not guaranteed to meet any marketplace’s main-image requirements. Review results before publication or decision-making. We do not guarantee uninterrupted or error-free service or exclude warranties or liabilities that cannot lawfully be excluded.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages; our aggregate liability shall be limited to the amounts you actually paid to the Service in the 12 months preceding the date on which the claim arose.
11. Changes to Terms
We may update these Terms and will display the updated date on this page. We will communicate material changes through appropriate channels. Continued use after an update takes effect constitutes acceptance. If you disagree, you may stop using the Service and request cancellation of auto-renewal. Updates do not affect rights that cannot lawfully be excluded.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of China, without regard to its conflict-of-law rules. Any dispute arising out of or in connection with these Terms or the Service shall first be subject to good-faith negotiation between the parties; failing such resolution, the dispute shall be submitted to the competent courts of Hong Kong. Nothing in these Terms shall exclude any rights you may have under mandatory consumer-protection laws in your jurisdiction.
